Terms and Conditions of Use – KingsAutoBid
1. Introduction
1.1. These Terms and Conditions (“Terms”) govern your use of our online vehicle auctioning platform (“the Platform”) operated by KingsautoBid (“we”, “us”, “our”).
1.2. By accessing or using the Platform, you agree to be bound by these Terms. If you do not accept these Terms, you may not use the Platform.
1.3. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Platform after changes implies your acceptance of the revised Terms.
1.4.. All users must be 18 years or older and have the legal capacity to enter into a binding contract.
2. Role of the Platform
2.1. KingsautoBid acts solely as an online intermediary between private vehicle sellers and potential buyers.
2.2. We do not own, buy, sell, or take possession of any vehicles listed on our Platform.
2.3. All vehicles are listed and offered for sale exclusively by third-party individuals or businesses (“Sellers”).
3. No Liability for Vehicle Condition
3.1. We do not inspect, verify, or guarantee the mechanical, physical, aesthetic, or legal status of any vehicles.
3.2. Buyers acknowledge that they are purchasing the vehicle directly from the Seller, and any issues or disputes regarding vehicle condition must be addressed with the Seller.
3.3. We shall not be held liable for:
- Hidden or latent defects;
- Accident damage;
- Tampering or mileage inaccuracies;
- Non-disclosed mechanical faults;
- Non-transferable warranties or service plans;
- Any cost incurred post-purchase due to repairs or roadworthiness requirements.
4. Listings and Descriptions
4.1. Vehicle listings are submitted by Sellers and may include descriptions, photos, specifications, and other details.
4.2. We make no guarantees regarding the accuracy, completeness, or authenticity of any vehicle listing.
4.3. It is the Buyer’s responsibility to conduct independent inspections, background checks, and verification prior to bidding or purchasing.
5. Buyer Obligations
5.1. Buyers agree to:
- Conduct due diligence :
- Confirm of the physical condition of the vehicle,.
- Status of Natis document(code 2 ,code 3 etc)
- before placing any bids;
- Ensure availability of funds before participating in auctions;
- Abide by all payment timelines and procedures as communicated.
- By placing a bid,you confirm the above conditions have being met by yourself
5.2. All bids placed are legally binding offers to purchase the vehicle, subject to acceptance by the Seller.
6. Seller Obligations
6.1. Sellers must:
- Accurately describe the vehicle’s condition and history;
- Disclose any known faults, damages, or defects;
- Be the legal and registered owner of the vehicle with the rights to sell /dispose off
- Provide valid ownership documents and a roadworthy certificate(if stated) where required.
6.2. Sellers indemnify KingsAutoBid against any claims, losses, or damages arising from misrepresentation, false information, or unlawful sale with the buyer.
7. Auction Process
7.1. Auction dates, times, formats, and minimum reserve prices (if applicable) will be communicated on the listing.
7.2. KingsautoBid does not guarantee that the highest bid will be accepted, as final sale is subject to Seller approval.
7.3. We reserve the right to withdraw any listing or cancel an auction at our discretion, without liability.
8. Payments and Fees
8.1. The Successful buyers and seller(both)will be required to pay an auction facilitation fee of R1250 each at the conclusion of a successful auction
8.2. Full payment fee must be received by each of the buyer and seller prior to the conclusion of any sale. Non-compliance may result in penalties or suspension of user accounts.
9. Title Transfer and Documentation
9.1. The responsibility to handle vehicle transfer, registration, licensing, and ownership documentation lies solely with the Buyer and Seller.
9.2. KingautoBid may offer administrative assistance at an addition fee, but assumes no legal responsibility for the accuracy or completion of these transactions.
10. Dispute Resolution
10.1. Any disputes between Buyers and Sellers shall be resolved directly between the parties.
10.2. While we may, at our discretion, assist in resolving disputes, KingsAutoBid is not liable for any claims arising from transactions between users.
11. Limitation of Liability
11.1. To the maximum extent permitted by law, KingsAutoBid, its directors, employees, or affiliates will not be liable for:
- Any direct, indirect, incidental, special, or consequential damages;to the vehicle
- Any loss resulting from your reliance on vehicle listings;
- Any damages arising from the use or misuse of the Platform.
- Loss of funds by the buyer in incorrect account details of the seller
- The buyer and seller both must secure each others details(transferring of funds)
12. User Accounts and Security
12.1. Users are responsible for maintaining the confidentiality of their login credentials and all activities conducted under their account.
12.2. Misuse of the platform, fraudulent activity, or any breach of these Terms may result in immediate termination of your access.
13. Prohibited Conduct
13.1. Users may not:
- Upload false, misleading, or illegal vehicle listings;
- Manipulate auction outcomes;
- Use the platform for unlawful purposes.
14. Indemnification
14.1. You agree to indemnify, defend, and hold harmless KingsAutoBid from any claims, damages, or liabilities arising from your use of the Platform or breach of these Terms.
15. Governing Law
15.1. These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa.
15.2. Any legal proceedings arising from these Terms shall be brought exclusively before the appropriate courts in South Africa.
16 Privacy and Data
16.1. We collect and process personal data in accordance to promote seller vehicle and buyers
16.2. Users consent to their contact and listing data being visible to other users for the purpose of completing transactions.
